房屋的勘察、设计、施工、监理等单位应当按照与开发建设单位签订的合同及有关法律、法规的规定承当房屋平安责任。
第十三条房屋共有局部的日常管理，实行物业管理的，物业效劳企业应当按照约定承当房屋平安检查、维修养护等日常管理责任，并将考前须知、禁止行为等书面告知房屋平安责任人，发现违法行为的，应当予以劝阻，劝阻无效的应当及时向有关部门报告; 实行自治管理的，其平安检查、维修养护等日常管理责任由房屋平安责任人依法共同承当。
房屋专有局部的日常管理责任由房屋平安责任人依法承当。
第十四条房屋平安责任人应当对房屋使用平安承当以下责任：
〔一〕按照设计用途、建筑物使用性质及房屋权属证明记载的房屋用途合理使用房屋；
〔二〕检查、维修房屋，及时治理房屋平安隐患；
〔三〕房屋的装饰装修不得影响房屋共有局部的使用，不得危及房屋的使用平安和毗邻房屋的使用平安；
〔四〕防治白蚁；
〔五〕委托房屋平安鉴定；
〔六〕采取其他必要措施保障房屋平安。
第十五条禁止实施以下危害房屋平安的行为：
〔一〕未经原设计单位或者具有相应资质等级的设计单位提出设计方案，且未经施工图设计审查机构审查同意，擅自变动建筑主体和承重结构；
〔二〕在承重墙上开挖壁柜、门窗洞口或者扩大房屋承重墙上原有的门、窗尺寸；
〔三〕超过设计标准增大荷载；
〔四〕在楼面、屋面结构层开凿洞口或者扩大洞口；
〔五〕降低房屋地面地坪标高；
〔六〕撤除或者改变商场、宾馆、饭店、影剧院、体育场馆等大型建筑中具有房屋抗震、防火整体功能的主体结构；
〔七〕违法存放爆炸性、毒害性、放射
