　　第十二条  农村村民申请宅基地的条件：
　　   （一）符合下列条件的，可以申请宅基地：
　　    （1）农村宅基地申请人属该农村集体经济组织成员的；
　　（2）申请地必须依法编制了城乡规划，并经政府批准实施的；
　　（3）申请地符合土地利用总体规划和土地利用年度计划，符合交通、通讯、电力、水利、水土保持等相关设施法律法规保护规定的；
　　    （4）符合每户只能拥有一处宅基地的法律规定的；
　　    （5）人均住宅面积不足30m2的；
　　    （6）年满18周岁的村民因婚姻（包括男到女家落户）等原因确需分户建房，且已有的宅基地不能分割或虽能分割但宅基地面积低于规定面积的；
　　    （二）根据村庄建设规划需要拆迁的；
　　    （三）因国家、集体建设项目征收需要拆迁而没有安置住宅的；
　　    （四）经县级以上人民政府批准回原籍落户定居，确无住宅的；
　　    （五）原有住宅破旧需要改造、拆迁或因灾倒房在原址新建且符合规划的；
　　    （六）原有住宅破旧或因灾倒房需另择地址新建住宅，新选地址在村庄规划区内，本人同意将原宅基地退还集体的；
　　    （七）县级以上人民政府规定的其它条件。
　　第十三条   如有下列情形之一的，不予审批宅基地：
　　    （1）农村宅基地申请人不属该集体经济组织成员；
　　（2）未依法编制城乡规划或未报政府批准的；
　　（3）不符合土地利用总体规划、土地利用年度计划、村庄和集镇建设规划、控制性详细规划的；
　　（4）申请地为未确权的土地或存在土地权属纠纷的；
　　    （5）不符合县城城市建设规划或集镇建设规划进行旧（危）房改建的；
