    （二）影响城市、镇景观和环境的；
    （三）影响居民正常生活和工作的；
    （四）影响城市、镇交通及公共活动场所人流集散的；
    （五）占用城镇绿地（包括公园、街头绿地、防护绿地等）、消防通道、高压供电走廊、防洪设施的；
    （六）占压地下管线和设施，影响其使用、维护和安全的；
    （七）占用公路两侧建筑控制区内的土地，影响城乡交通和安全的；
    （八）法律、法规规定的其他情形。
    第九条  临时建设和临时用地的批准使用期限，不得超过两年。临时性房屋的层数不得超过一层，高度不得超过４米。临时性建筑物、构筑物不得采用现浇钢筋混凝土等永久性的结构形式。
    第十条  城乡规划主管部门核发临时建设规划许可证时，应对其使用性质、位置、建筑面积、平面、立面、高度、风格色彩、结构形式、期限等作出明确规定；核发临时用地规划许可证时，应对其使用性质、位置、面积、期限等作出明确规定。
    同一条街道或同一类型的临时建设应协调统一，并与周围环境相适应。
