第九条从事互联网食品药品经营的网站，除符合食品药品监督管理法律、法规、规章要求外，还应当具备以下条件：
〔一〕取得互联网增值电信业务经营许可证；
〔二〕具有网上查询、生成订单、电子合同、网上支付等交易效劳功能；
〔三〕建立交易平安管理制度和保障措施，能够实现可追溯；
〔四〕建立保障食品药品平安的储存和运输管理制度；
〔五〕建立投诉举报处理、消费者权益保护等制度。
第十条从事互联网药品、医疗器械经营的，除符合第九条规定条件外，还应当具备以下条件：
〔一〕开展网上咨询效劳；
〔二〕销售处方药、甲类非处方药的，建立执业药师在线药事效劳制度，由执业药师负责处方的审核及监督调配，指导合理用药；
〔三〕建立药品不良反响报告、不合格药品召回制度；
〔四〕建立医疗器械不良事件监测、不合格医疗器械召回制度。
第十一条互联网食品药品经营者应当将网址、IP地址等信息备案至原颁发经营许可或者备案凭证的食品药品监督管理部门，同时应当在其网站首页醒目位置公开其营业执照、经营许可证件或者备案信息，公示其执业药师信息，并提供与食品药品监督管理部门官方网站的电子链接。经营许可、备案信息发生变更的，互联网食品药品经营者应当及时更新。
