叉车维修保养效劳合同
甲方：
乙方：
根据?中华人民共和等自愿的原那么，通过友好协商，乙方将为甲方51台厂内机动车提供维修保养效劳。达成以下条款：
职责与义务
乙方：
1、本合同有效期内乙方必须严格遵守国家法令及政府的各项政策，合法用工，如违反乙方自行负责。
2、乙方必须建立完善的效劳记录，每次效劳记录需要甲方现场人员确认，并每月由效劳单位将确认结果电子版报送甲方相关管理人员汇总
3、保养按月度、季度、半年、年度，叉车保养手册标准要求保养。每次保养，乙方无偿向甲方提供一份叉车保养记录。
4、乙方接到甲方修理通知后，需在30分钟内到达甲方现场进行维修工作。
5、每次维修后，由甲方司机进行试车，乙方对其更换零部件必须进行质保。
6、乙方须遵守甲方平安规章制度与文明生产规定，配合甲方对叉车的管理工作。
7、乙方劳务人员违反甲方平安规章制度与文明生产规定，按甲方制定的平安规章制度与文明生产规定的处分条例进行处分。

甲方：

2、甲方对乙方效劳人员提出的建议，有采纳和否认的权利。
3、结算方式：乙方提供正规增值税发票，甲方每季度末支付合同总价的1/4。

〔三〕合同期限
本协议有限期为12个月，从2024年 月 日到 2024年 月 日。
〔四〕施工平安
乙方应确保人身与机械平安的前提下进行施工，乙方在施工中所出现的任何人身与机械事故，均由乙方自行负责。
〔五〕解决纠纷：
本合同的签署或履行有关的一切纠纷通过友好协商予以解决，如协商不成交由甲方所在地仲裁机构仲裁。
〔六〕合同变更或终止：
1、乙方保养或维修质量达不到技术要求，甲方提出改进意见后，仍没有改进，影响甲方正常运作，甲方有权立即终止合同，无须提前通知及承担任何违约责任。
2、因乙方管理不善给甲方造成经济损失的，乙方赔偿甲方损失金额后，甲方可立即终止合同，而无须提前通知及承担任何违约责任。

3、乙方劳务人员违反甲方规章制度，经甲方通知乙方，乙方及乙方工作人员仍不更改的，甲方可立即终止合同，而无须提前通知及承担任何违约责任。
4、除上述情况外，无论当事人任何一方提出终止合同，均应提前一个月通知对方。
〔七〕其他
本合同一式陆份，甲乙双方各执叁份，未尽事宜双方协商解决；本协议经双方签字盖章后生效，双方务必共同遵守。
