摘要
要约与承诺是国际货物买卖合同的成立必须具备的条件,对于合同的订立来说至关重要,卖方和买方的义务是国际货物合同法的核心内容。买卖双方订立合同后双方当事人都要履行合同。履行合同就是有关当事人按合同规定履行各自的义务,行使和实现各自的权利。各国买卖立法和《国际货物销售合同公约》都对买方和卖方的义务作了规定。

Concerning the establishment of the international contract of buying and selling of goods and the buyer and the seller's obligations
Abstract
Offer and acceptance is the establishment of the international contract of buying and selling of goods must have a condition, is crucial for to enter into a contract, the seller and the buyer's obligation is the core content of international goods contract law. The buyer and the seller after the conclusion of the contract the parties are to perform the contract. To perform the contract is about to perform their respective obligations as stipulated in the contract, the parties to exercise and realize their own rights. Countries trade in legislation and the convention on the international sale of goods are the obligations of the buyer and the seller.

一·要约与承诺
合同成立的实质要件是当事人之间意思表示一致,依法达成协议。实践中,当事人双方当面磋商,起草和签订合同,签订合同的时间和地点就是合同成立的时间和地点。不难判断。但是双方不在同一地点,用信函、电报、电传订立合同,合同是否成立,何时达成交易,比较难判断。所以,国际贸易形成了关于要约和承诺的国际惯例,法律制度。它可以作为我们判断合同成立与否
