浅谈我国征地补偿纠纷及解决对策
摘要:征地补偿是指国家为了公共利益的需要,按照法律程序强制性的变更农村土地所有权或使用权,并依法给予农村集体经济组织和农民个人补偿的行政行为。现阶段,我国征地补偿仍存在征地补偿标准不合理、征地补偿标准偏低、补偿方式单一、征地程序不透明和征地后农民的就业得不到解决等问题。制度上的缺陷带来了大量征地纠纷,激化了政府和农民之间的矛盾,影响了社会的稳定。为了解决征地过程产生的纠纷,首先要从补偿制度上进行改革:提高征地标准、丰富补偿方式、合理有效的监督征地补偿的过程,尽可能的降低农民失去土地后的损失;其次要提高全民的法律意识,通过法律手段解决征地纠纷,而不是妄想通过暴力手段累解决问题。只有这样才能缓和社会矛盾,构建和谐社会,才能有利于我国经济社会的可持续发展,把我国建设成科学的现代化国家。

The disputes and countermeasures of land pensation
Abstract:pensation refers to the need in the public interest, in accordance with the approval of the approval authority and procedures of the law and shall be given to the rural collective anizations and individual pensation, a mandatory change of rural land ownership or right to use administrative behavior. Currently,our country land pensation there are still exist a lot of problem, like unreasonable standards of pensation, low standards of pensation, single method pensation, Non-transparent land acquisition process and low employment rate after losing their land. Institutional deficiencies directly lead to appear a lot of land acquisition disputes in our country. We should to perfect pensation system first, and supervision the whole process of Land pensation effectively. Second, we must improve the legal awareness of our people, and resolved the land acquisition and disputes through legal way, rather than violent. This is only way to build a harmonious society,to conducive to sustainable economic and social development, can be more conducive to the modern country of the construction of scientific.
