论清代的“存留养亲”制度

摘要: 在规定有存留养亲制度的诸朝法律中, 清代的存留养亲制度可以说是形式多样、较为完备并得以有效运用的
一项法律制度。清代存留养亲的类型、成立的条件及其特点, 特别是它所体现出的人性关怀对我们今天的司法实践仍然有着
借鉴意义。

Abstract: T he system of “Cun Liu Yang Qing ”in Qing Dynasty , the sy stem w her m utation or
suspension of penalties, w as g ranted to some conv icted criminals so as to enable them to take care of their
old o r sick parents. Co mpared w ith the sam e sy stem in other dy nastie, it w as relativ plete and
diverse in fo rms. T he for ms, conditio ns of establishment and characteristics, especially the care of the
hum anity it reflected, co uld still be used as refrence to the judicial practice in China today .
