题目当前我国法律移植特点分析──以刑法为例

内容提要
法律移植是指特定国家(或地区)的某种法律规则或制度移植到其他国家(或地区),它对于任何一个法律体系尚不完备的国家和地区来说,都具有着巨大的理论意义和现实意义,特别是在当前,随着全球一体化趋势的不断深入,各国各个层次之间的交往的不断深化,国家或地区之间的法律交流也在不断的深化,不同地域、法域之间的法律移植实践在大量的发生。在此趋势下,如何最大限度的科学移植外国先进的法律制度并发挥其效用,是实现法律现代化的一个不容回避的问题。本文将从法律移植的含义出发,对其的必要性和可行性进行阐述,分析法律移植中所要面临的本土化过程,并结合我国近代刑法引进外国法律的历程,探索在进行我国当代刑法现代化途中所应选择的发展道路。

Abstract
Legal transplant indicates the transplanting of some legal rules or system from one country (or area) to another, it has great academic and realistic significance for any country or area whose legal system is not plete. Especially in nowadays, with the deepening of the global integration trend and the interaction of various levels between countries, degree of the legal exchange between countries and regions is deepener, too. The practice of legal transplant between countries and regions happens a lot. In this tendency, how to transplant the foreign advanced law scientifically with a maximum limit and exert its utility, that will be a inescapable problem in realizing legal modernization. This paper begins with the conception of the legal transplant, expounds its necessity and feasibility, analyses the process of localization that legal transplant will meet, bine with the progress of introducing the foreign modern criminal law into our country, which way we’ll choose in the course of the modernization of Chinese contemporary criminal law.
