我国道路交通安全管理与立法的缺陷、冲突及对策研究

摘要

随着经济和社会的发展,人民生活水平的不断提高,出行和交通
已经日益成为人们关注的焦点,而对政府来说,道路交通安全管理更
是公共管理的一项重要内容。许多国家已经在交通可持续发展报告中
将交通安全摆在首位,发达国家制定的交通战略计划也将交通安全作
为首要目标,都明确指出要实现以减少交通伤亡,促进公众健康,改
善公共安全为目标的交通安全性战略。虽然我国的汽车工业还处于起
步阶段,但在一些大城市,道路这一公共资源已经出现严重短缺的现
象,道路交通安全问题也越来越困扰着政府和社会。适逢《中华人民
共和国道路交通安全法》实施两周年之际,笔者作为一名法律工作者,
在学习了公共管理硕士的所有课程后,站在立法者、管理者和守法者
等不同的角度,运用公共政策分析等相关理论手段,对我国道路交通
安全管理的现状、管理和立法中存在的缺陷和冲突以及产生原因等问
题进行了深入的分析和研究,并借鉴西方发达国家的有益经验,提出
了引入公民参与理论、不断提高立法和执法水平、合理运用现代化安
全管理手段、深化道路交通安全宣传与教育等多种方法、对策和构想。

MEASURE OF ROAD TRAFFIC SAFETY
ADMINISTRATION AND LEGISLATION

ABSTRACT

With the development of social economy and living conditions,
traffic problems have e focusing issues of people’s daily life.
Road traffic safety administration is one of the most important aspects of
public administration. Governments in most countries have highlighted
traffic safety in their sustainable traffic development reports. In some
developed countries, governments have implemented the traffic strategy
focusing on decreasing traffic injury accidents, promoting public health
and improving public safety. The automobile industry of China is still
in the development stage, however the shortage of public traffic resource
and road traffic safety problem has arisen local governments’ attention in
some large cities. At the time of the implementation of Road Traffic
Safety Law, the author, from the viewpoints of legislator, administrator
and judicial officer, studies on the deficiency, conflict, and reason of
China’s road traffic safety situation, administration and legislation, brings

forward the theory of public participation, measures and suggestions to
improve the standard of legislation and administration, apply modern
safety control technology, and deepen
