中国房地产土地管理机制研究以上海为例

摘要

积极培育和完善市场体系是我国建立社会主义市场体制的重要
环节和内容而土地市场又是市场体系中的重要部分之一随着改革
开放的深入和经济建设的快速发展土地管理工作越来越受到各级政
府和广大民众的关注土地不仅是资源同时也是资产的意义逐渐被
人们认识如何利用这一有限资源使其充分发挥作用如何改革土
地使用制度完善土地市场已摆到了重要议事日程由于历史的法
律法规的人们观念等方面的原因目前我国的土地管理机制尚存在
许多问题这些问题不仅妨碍了市场公平还影响到了我国的投资环
境如何规范现行的土地管理机制维护市场公平不仅是土地管理
的主要内容也是土地管理部门的重要任务
本文通过对土地使用制度演变过程的回顾以上海为例分析
研究了目前我国房地产土地管理机制存在的问题及产生的原因具体
论述了政府对土地一级市场垄断的不足土地规划实施的失控土地
保护与发展的失衡土地监察的不力等问题在此基础上提出了一
个健全有效的房地产土地管理机制应具备的要素同时对如何改进
目前的房地产土地管理机制提出了对策和建议文章通过数据分析及
对比分析进一步阐述了建立健全有效的房地产土地管理机制的重
要性对土地管理部门实现这一目标和改善工作都具有一定的指导意
义对加强土地管理贯彻土地资源和资产并重管理原则推动社会
经济持续发展和进步具有重要的现实意义

ABSTRACT

It is important foster and improve the Market system in establishing
socialistic market system, in which land market plays an important role in
market system. Along with the deepening of China’s reformation and
opening up, and rapid growth of economy, land administration is getting
more and more attention from government mon people. People
gradually realize the concept that land is not only a kind of resource but
also a kind of asset. How to fully utilize such a limited resource, and
reform the stipulation of land using is time pressing. Due to the reasons of
history, legislation and conception, at present there are still many problem
in estate land administration mechanism. These problem not only hamper
the equity of market but also affect the invest environment of China. How
to standardize the estate land administration mechanism at present and
maintain the market equity is not only the main content of land
administration but also the main task of the land administration
department.
