摘要
非法行医罪是我国1997年刑法第336条第一款新确立的罪名,由于立法上的笼统与不完善,理论上本罪的诸多关键问题一直存在争议,实践中对该罪的定性量刑也有较大的分歧。本文拟从我国现行刑法典的法条表述出发,结合刑法理论,对非法行医罪的一些问题加以探讨,采用举例、比较、实证分析等研究方法进行探讨和论证,并对本罪在司法实务中迫切需要解决的法律问题,提出立法完善的构想,希望为非法行医罪的理论研究略尽绵力,全文内容分以下五部分:
。这—部分为概括性介绍,主要介绍分析了非法行医罪的概念、我国关于非法行医罪的立法概况以及存在的原因。
。本课题认为,非法行医罪的主体是特殊主体,是“未取得医生执业资格的人,并对目前有关非法行医罪主体争论较多的几个问题进行了介绍分析,例如与主体相关的一些问题:本罪主体是一般主体还是特殊主体,超越执业地点、执业范围、执业类型是否构成本罪,单位、实****生能否成为本罪主体等等。
。理论学界对基本犯罪主观方面与结果加重犯主观方面的争议颇多,本罪主观方面是故意,主要表现为直接故意,加重结果犯罪为过失,本课题研究这方面的主观方面。
。主要阐述“情节严重”的认定与被害人的承诺两方面的相关问题。
。就非法行医罪的主体范围、情节严重的标准、主观方面等问题,指出我国刑事立法的不足,提出立法完善构想,认为应明确非法行医罪的主体范围、犯罪行为和情节,增加单位犯罪条款
