离婚案件中的夫妻双方当事人因情感、性格以及其他原因导致对簿公堂,无论离
婚诉求准许与否,该类案件无生活或者实质意义的胜诉方,但无一例外的是,心智尚
未成熟,生理、心理尚处于发展阶段的未成年子女则因此受到成长上的困扰乃至负面
影响,成为实质意义的“败诉方”。未成年子女作为特殊的主体,在婚姻家庭案件的
司法过程中理应受到国家、社会更多的关注和保护。
本文从离婚诉讼中未成年子女诉讼权利保护的理论基础入手,阐述了未成年子女
诉讼权利的构成和意义。继而就婚姻案件中未成年子女诉讼权利保护的现状进行分
析,在借鉴国外立法司法经验的基础上,提出完善我国相关制度的基本设想。笔者建
议在离婚诉讼中要贯彻落实子女最佳利益原则,以使婚姻家庭案件中未成年人的合法
权利得到最充分最合理的保障,使未成年人诉讼利益得到最切实的保护。

Abstract

Husband and wife both parties in divorce cases lead to court due to emotion,
personality,and for other reasons,regardless of the divorce demands permitted or not, in
such cases no life or meaningful prevailing party,but without exception,are still
immature,physiology,psychology is still in the stage of development of the minor children
troubled growth and even negative impact,e the meaningful "loser". Minor children
as a special subject deserves more attention and protection of the state, society,the
judicial process in cases of marriage and family.
In this paper, the theoretical basis of the protection of the rights of children of
divorce proceedings minors litigation,elaborates position and significance of the
minor children of the right to litigate. Turn to the litigation rights of minors in matrimonial
cases to protect the status quo analysis, learn from foreign legislative,judicial experience
on the basis of the basic idea to improve our system. I suggest to implement the principle
of maximizing the fullest and most reasonable protection so that the legitimate rights of
minors in cases of marriage and family,so that minors litigation interests of the most
