摘要
风险是一种以知识为前提的特殊无知。只有通过风险的双重本质论才能认识风险社会产生和发展的内在逻辑。风险社会就是未来决定当下,知识引领未来的一种社会形态。“风险社会”与“知识社会”在本质上是完全一致的,是一个问题的两个方面。“风险社会”和“知识社会”的诞生,意味着“传统社会”或者“自然社会”的终结。
风险法学就是站在传统和自然终结的历史高度,反思当代社会风险及其制度弊端。
风险社会作为一种世界观,是对马克思主义的辩证唯物主义世界观的发展和具体化。风险法学以风险社会理论为指导思想,研究风险法则,研究利益分配和风险分配,追求利益分配和风险分配的公平和平衡,保障政治、经济、社会健康发展和可持续发展。
风险法学与传统法学相比,不仅仅引入了新的研究对象,同时引入了新的研究方法。风险法学的确立,不仅仅是一个法理学问题,而是建立一个新的法学体系的系统工程问题。可以预见,这个体系包括国际风险法学和国内风险法学等多个分支学科和交叉学科。

Abstract
Risk is one kind of special ignorance with a prerequisite for knowledge. Only through the dual nature of the risk theory,the internal logic of risk society’s emergence and development can be known by human. Risk society is a social form in which the future decides the present, and the knowledge promotes the future. "Risk society" and "knowledge society" are essentially identical, like two sides of the same coin. The emergence of the "risk society" and the "knowledge society" means the end of the "traditional society" and the "natural society".
The risk jurisprudence try to reflect the contemporary society and its system of malpractice risk form a historical height where the "traditional society" and the "natural society" are ended. Comparing to traditional jurisprudence, the risk jurisprudence introduces new objects of study and research methods. Its establishment is not only a simple question about the perspective of jurisprudence, but also brings the born of a new jurisprudence system. And it’s foreseeable that the new jurisprudence system will cover many branches of law and other interdisciplinary majors, including the international risk jurisprudence, the domestic risk jurisprudence and so on.
