从仲裁与调解相结合到单独调解

要: 2008年
北京仲裁委员会调解规则的实施, 意味着中国仲裁机构运用调解的方法
解决争议不仅有仲裁与调解相结合, 还有单独的调解。依前述规则, 调解的采用费用低、时间短,
即使调解未成功也不至拖延当事人解决争议的时机。仲裁与调解相结合固然获得成功, 但单独调解
理论上更有优势。

Abstract: The instrum en t o f the Be ijing A rb m ission M ediation Ru les since 2008 has m ade it c lear
that Ch inese arb itration institutes m ed iate d isputes by w ay o f bining arb itration w ith m ediation and separate
m ediation. In accordance w ith the foresa id ru les, the use of m ed iation takes low cost and short tim e, and w ill not
postpone the oppo rtun ities for parties to resolve the ir d isputes even if the m ediation finally failed. Com bining arb itra
tion w ith m ed iation eeds in practice, but separate m ed iation has m ore advantages in theory.
