摘要
消防行政执法主体依法承担着消防监督、消防处罚、消防检查等任务,在规范消防安全环境、维护社会消防安全工作中发挥了重要的作用。然而,由于各种原因,消防行政执法违法时常会出现,这不仅对我国消防行政法治建设产生影响,而更重要的是侵犯了消防行政相对人的合法权益。建立一套法律责任制度即通过推进消防行政执法责任制,追究有关违法主体和人员的责任来监督和制约消防行政执法,势在必行。但追究违法主体的责任也必须在法律框架内进行,防止追究的任意性和主观性。本文从消防行政执法违法主要表现,消防行政执法违法归责原则、消防行政执法违法追究的实施三方面进行了论述,并对消防行政执法违法追究中如何做到“合法”、“合理”追责,提出了自己的看法:在消防行政执法违法归则原则上以责任自负为前提、以过错责任为基本归则原则、避免无过错追责原则、贯穿公平公正原则;在追责原则上遵循责任法定原则、责任与违法程度相一致的原则、制裁与教育相结合的原则;在消防行政执法违法追究的实施过程中要坚持专门机构进行追责、要在查清事实基础上进行责任追究、要按照归责原则确定责任、要赋予违法当事人陈述和申辩的权力等。只有坚持以上原则和要求,才能既达到追究违法责任的目的,又不挫伤执法人员的积极性。

Law Enforcement Responsibility Of The Chief Fire Research
Abstract
According to the law, the subject of Fire administration enforcement takes the responsibility of fire monitoring, fire punishment, fire inspection tasks and so on. Meanwhile, it plays an important role in regulating fire-safety environment, and the maintenance of fire safety in the work of social responsibility. However, due to various reasons, the subject of administration enforcement turns out to break the law from time to time, which not only influences the construction of the fire administrative rule of law, but, more importantly, violates legitimate rights and interests of people who are related with the fire administration. Therefore, it is imperative to set up a law system to investigate the responsibility host and related persons in order to monitor and restrict the action of fire administration enforcement. In addition, investigating the responsibility of the host must be conducted within the framework of the law to prevent the arbitrary and subjectivity. In this paper, it analyzes the main manifestation of fire administration enforcement and illegality, fire administrative law enforcement and illegality imputation principles, and the implementation of investigating the responsibility host.
