摘要
改革开放特别是在20世纪90年代以后,中国对外贸易取得了长足的发展,2006年中国出口贸易额达到了万亿美元,稳居世界三大出口国之列。但是,由于中国产品出口秩序混乱、增长过于迅速、国际上对华的歧视性做法等原因,使得我国已经成为国际反倾销的头号目标国。而非市场经济待遇和企业应对反倾销诉讼不力等问题又使得我国产品屡遭反倾销制裁。频繁发生的对华反倾销案已对中国出口贸易的发展产生极其不利的影响。
反倾销已成为我国对外贸易的最大障碍。大部分反倾销诉讼来自发达国家,但近年来发展中国家对我国的反倾销指控不断增加。反倾销税逐步攀升,被指控的产品价值越来越大。入世后,对我国的反倾销起诉不减反增。原因是多方面的,我国出口的高速增长使其他国家不安;被诉企业不积极应诉;预警机制与反倾销立法尚未完善;国外对我国存在歧视行为,视我为非市场经济国家;出口价格过低;入世承诺给企业带来一定的压力。
文章共分为四个部分,第一部分首先从倾销的经济学定义入手,揭示出倾销的实质,并详细阐述如何确定倾销以及认定程序。第二部分概述了国外对华反倾销的特点,指出我国现在已成为国际反倾销中的最大受害国。第三部分从国际和国内两个方面分析了我国频遭反倾销的主要原因。文章第四部分,并进一步提出了在应对反倾销的这场战役中,我国政府和企业各自须采取的相应对策。

STRATEGY OF MODITIES DEAL WITH ANTI-DUMPING
ABSTRACT
Since the reform of opening, especially the 1990s, China has made a big progress in the field of international trade——the value of export achieved
one thousand billion US$ and ranged the third of the world. Due to the disordered and exceeding growth of exportation and discrimination, China has e the main accused country in lots of anti-dumping issues. Unfortunately, the Chinese enterprises often suffered for the sanction because of the no market economy treatment and inefficacy in defence of dumping lawsuit. Frequent dumping lawsuits against Chinese enterprises have had a malignant effect on the Chinese international trade.
China has been the biggest victim of anti-dumping. The developed countries brought most of anti-dumping suits, but in recent years developing countries bring more and more suits against China. The rates of the anti-dumping tariff get higher and higher and the value of the sued products gets greater and greater.
This paper has four section parts, the first section starts from the economic definition of dumping, then declares the essential of dumping, expatiates necessary factors of dumping verification and identified process . The second section analyzes the characteristics and influence of foreign countries’ anti-dumping against China, declares China being a biggest victim of anti-dumping. The t
