Proposal for a
COUNCIL REGULATION

in the People's Republic of China and Saudi Arabia, amending Council Regulation (EC)
No 2852/2000 imposing a definitive anti-dumping duty on imports of polyester staple
fibres originating in the Republic of Korea and terminating the anti-dumping
proceeding in respect of such imports originating in Taiwan

EXPLANATORY MEMORANDUM
On 19 December 2003, mission initiated an anti-dumping investigation with regard to
imports into munity of polyester staple fibre (PSF) originating in the People’s
Republic of China (PRC) and Saudi Arabia. On the same day, mission initiated an
interim review concerning imports of the same product originating in the Republic of Korea
and Taiwan.
Given the need to further examine certain aspects of injury and causation, no provisional
measures were imposed in the proceeding concerning the PRC and Saudi Arabia.
Subsequently, the results of both proceedings bined.
Out of five Chinese exporting producers claiming Market Economy status only one fulfilled
the necessary criteria to be considered as operating under market economy conditions. For the
remaining four Chinese exporting producers normal value was established on the basis of data
pertaining to a producer in an analogue country, . the United States of America. Three of
the panies fulfilled the criteria of Article 9(5) of the Basic Anti-dumping Regulation
and individual duties were established for them. Significant dumping was found for all
exporting producers in the PRC.
Out of two Saudi Arabian exporting producers one provided unreliable information. The
dumping margin for this exporting producer was set at the same level as for the second
exporting producer in Saudi Arabia.
