摘��要�

在法治化进程中,法律如何适用是实现法治的焦点问题之一,而对这一问题
的解答又不能忽视对法律解释问题的研究。法之推行,轻解释则难以畅通;没有
科学的法律解释,法律无法得以正确运用。法律解释在法治实践中发挥着越来越
重要的作用。
在现代法律实践中,把法律适用者视为自动售货机的机械主义思想已不能适
应法律的现实发展。法律不可能包含解决问题的一切方法,它需要依靠主体的理
解与参与来保持旺盛的生命力。但法律解释的运行必须有一定的限度,无论在主
体、客体、方法上,还是在价值、权力范围等方面都应该加以限制。要增强法律
解释运行的合法依据,进而确保法律解释的正常运行。
我国的法律解释制度是伴随着司法制度的现代改革逐步建立起来的。1981
年,《全国人大常委会关于加强法律解释工作的决议》的出台,标志着我国立法
解释、司法解释、行政解释共存的法律解释体制的确立。本文通过对当代中国法
律解释体制的成因和现行规定的梳理,发现我国法律解释实践存在着诸多问题,
譬如多元解释主体并存、解释主体越权、立法解释地位倒置、具体操作制度欠缺,
以及忽视法官解释权等等。
针对我国法律解释体制的弊端,构建适合我国的法律解释体制成为必要。改
革我国的法律解释制度,必须厘清法律解释权的拥有主体,保持立法解释权的谦
抑状态,取消行政机关和检察机关的法律解释权,强化法院与法官的司法解释权。
从现代法治意义上讲,法律解释即司法解释,法律解释的司法化将有助于法治的
发展。提高法官运用法律解释权的能力,是法律解释发展的一个关键问题。同时,
引进判例制度,加强法律解释的制度化,对保障法律解释规范有序发展具有重要
意义。

当代中国法律解释探究

Abstract

In the progress of the rule of law, how to apply the law is one of the focus
problems which carry out the rule of law, but we can't neglect the research to the legal
interpretation in order to answer this question. If we can’t attach importance to the
legal interpretation, the law can’t proceed smoothly; the law can not be applied
correctly without scientific interpretation. The legal interpretation develops more and
more important function in the rule of law.
The Mechanical thought that regards the person of applying law as vending
machine hasn’t already adapted the realistic development of law, and it is impossible
for law to include all methods of problem-solving, then it needs to depend on
comprehending and participation of persons to keep prosperous vitality. But the legal
interpretation has to have certain limit in the aspects anization, object, methods,
value and power scope etc. So it can strengthen legal basis in order to insure the
normal movement of legal interpretation.
The system of legal interpretation is built up gradually with modern reform of
judiciary in China. The annunciation of 《the resolution about strengthening the work
o
