摘要
从1900 年在美国纽约出现了世界上第一例交通死亡案例至今百余年,全球死于陆地交通事故的人数超过3200 万人。与世界其他国家相比,我国交通肇事造成的危害要大得多。我国交通肇事犯罪发案率居高不下的原因是多方面的,但在交通肇事方面立法的不完善应该是主要的原因之一。我国关于交通肇事的法律、法规主要是刑法及解释。我国关于交通肇事罪的法条规定为空白罪状,主要根据交通管理法规定罪量刑,而交通管理法规凌乱且分散。由于交通肇事罪的法条规定方式为空白罪状,因此,交通肇事罪名较少。刑法修正案(八)将醉酒驾驶,飙车等行为增设为犯罪这是我国在交通肇事罪方面立法的完善与进步。
全文共分以下五个部分:第一部分,旨在介绍选题背景及意义,国内的研究现状,本文的研究方法及主要的创新观点,为其后的论述奠基。第二部分,旨在阐明相关概念特征其犯罪的主体与客体,使读者能够较为形象的对其进行理解。第三部分,旨在阐明增设交通肇事罪这些罪名的必要性。第四部分是对于最新设立的危险驾驶罪,做出系统分析。第五部分,主要为在对以上几部分研究的基础上,找出我国之不足之处与下一步发展方向,提出自己的一点想法。

Abstract
From 1900, the United States occurred in New York over hundreds of years since the first cases of traffic deaths in the world, the global number of deaths from traffic accidents on land more than 32 million people. Compared with other countries in the world, there is much greater harm caused by a traffic accident in China. High incidence rate of traffic accident crime in our country there are many reasons, but in traffic offending legislation is not perfect should be one of the main reasons. Laws and regulations of traffic accident in China are mainly in criminal law and interpretation. Law provisions on the crime of causing traffic casualties in China blank charges, main conviction and sentencing by traffic regulations and traffic regulations are messy and fragmented.
