自世纪年代以来,随着农村人口的快速增长和农村经济的不断发展,
农业综合开发规模和乡镇工业对资源的利用强度日益扩大,农村生态环境问题
越来越严重,以成为我国环境问题的一个重要方面。解决好农村生态环境问题
不仅有利于我国环境保护事业的发展壮大,还有利于我国社会经济的持续、稳
定、健康发展。
本论文从我国农村生态环境问题的现实形势入手分析了具体存在的法律
问题并指出在诸多影响我国农村生态环境问题恶化的原因中农村生态环境立
法保护不完善、执法中法律依据不明确、监督管理不到位、农民生态环境保护
法律意识薄弱等是导致我国农村环境问题恶化的直接的、现实的、主要的原因。
本文在具体分析我国农村生态环境法律现状的基础上,借鉴发达国家的先进经
验提出了一些有利于我国农村生态环境法律保护的构想。当然影响我国农村
环境问题恶化的原因是多方面的有社会方面的原因政策方面的原因观念方
面的原因等更有法律方面的原因。从长远来看只有将农村生态环境纳入法制
化轨道充分发挥法律在农村生态环境方面的预防作用、救济作用、惩治作用
才能保护农村的生态环境,才有利于农村的和谐发展。我国农村生态环境问题
是一个高度复杂的问题它的解决任重而道远需要我们给予更多的关注投入
更多的人力、物力和财力,农村环境保护工作是一项系统工程需要在长时期内
不断推进。

Abstract
Since the 70s of the 20th century, with the rapid growth of population and continuous
development of economy in rural areas, the scale of prehensive agricultural development
and the intensity of the use of resources are increasingly expanding. At the same time, the
eco-environmental problems are getting worse and has e an important aspect of the
environment. Solving the rural eco-environmental problems is in favor of not only the development
of environmental protection cause, but also good to the sustainable, stable and healthy development
of society and economy.
In this paper, specific legal issues are discussed from the situation of today's
eco-environmental problems in our rural areas. It also points out that there are many reasons for the
deterioration of rural eco-environment. Among them, the direct, practical and principal reasons are:
the imperfect legal protection of rural eco-environment, the indefinite legal basis during enforcing
law, the immature supervision and management, and the peasants' weak awareness of
eco-environmental protection law. This paper specifically analyzes the present situation of today's
rural eco-environmental law. On the basis of that and with the advanced experience of developed
countries, it proposes some ideas in favor of the rural eco-environmental legal
