摘要
近年来,随着我国市场经济的不断发展,知识产权观念的深入人心,社会各界对知识产权的保护意识也在逐步增强。其主要表现为,知识产权及其相关权利之间的权利冲突案件正在逐年递增。为此,本文试图从商标权与企业名称权的概念入手,分析其权利冲突的产生原因和表现形式,进而提出对这一问题的解决途径。希望通过本文,能够给我国法律在商标权与企业名称权的权利冲突问题上的漏洞和空白提供一些立法建议,并最终达到指导司法实践的目的。

ABSTRACT
In recent years, along with the continuous development of the market economy and the social pervasion of the intellectual property concept, the protection consciousness of intellectual property from all walks of life is also being gradually increased. The main result shows that the law cases of the confilct between intellectual property and its related rights are being increased , this essay will attempt to start from the conception of trademark right and the enterprise's name right to analyse the reason and manifestation of the right conflict. Then it will provide some methods to solve these , it will also provide some legislative proposals for the legal loophole and blank in the conflict between trademark right and the enterprise's name right in our , it will achieve the aim of guiding judicial practice.
