第三部分,其他国家或地区票据权利纠纷司法救济途径的考察。该部分从
票据法系入手,着重对与我国票据法系相同,诉讼制度类似的德国和日本的票
据诉讼制度进行了介绍,从中我们发现德国、日本非常注重票据无因性、文义
性等特点,设置了符合票据权利纠纷特殊性的票据诉讼程序来迅速、快捷的化
解票决权利纠纷,这为我国票据诉讼制度的改革提供了极具参考价值的经验。
第四部分,我国增设票据诉讼程序的必要性和可行性。通过仔细分析,我
们发现我国迅猛发展的票据市场需要高效、便捷的票据诉讼程序,繁简分流的
诉讼制度转型思路和商事审判独立化的趋向也要求增设票据诉讼程序。此外票
据权利的特殊性和德日两国的票据诉讼制度为增设票据诉讼程序提供了可行
性。
第五部分,我国票据诉讼程序的构建。本部分关于程序的构建主要从与现
有程序分流与转化、程序自身高效、便捷两大理念出发,对于票据诉讼程序的
适用范围、管辖问题、证据方法、判决后程序设置等方面进行了设计,实现督
促程序、票据诉讼程序、普通诉讼程序之间的对接,以期达到案件分流、程序
与案件相当、当事人程序择权利益充实的目标。

Abstract
At present there is no special procedures of negotiable instruments in China,
disputes over the right of negotiable instruments of judicial remedy only ordinary
procedure and procedure two, the general procedure is the most used relief program.

obvious, the exercise of rights without due bills, bills right request according to the

bill right disputes, trial procedures, time-consuming, complex litigation can not be
timely, accurate adjustment of bill relationship. The dilemma Chinese type under the
supervising procedure is influenced by the credit system is not perfect, application
settings is not reasonable and its application characteristics and other reasons, in the
settlement of disputes over the right of negotiable instruments is always unsatisfactory.
Through the investigation for the German, Japanese procedural system of negotiable
instruments, as well as for the rapid development of China's bill market analysis and
civil litigation system to adapt to the transition of the split flow requirements, our
