摘要

近年来,环境法治正成为环境法学者提的最多争论最多的话题,环境公益诉
讼是热门焦点之一。在我国,环境公益诉讼还没有具体的制度规定,只在其他法
律上有一些附带规定。可以说我国的环境司法状况并不乐观,传统的诉讼制度在
运用其刑事民事行政三大诉讼制度来解决全新的环境纠纷、保护环境权中发挥了
其应有的重要作用外,也面临着新的挑战,即如何适应环境法这一社会性法域的
特性和保护好环境公益性权利。本文综合了国内外众多学者的观点,试图探究出
一条具有中国特色的环境公益诉讼制度。
在本文中,重点讨论三个问题:第一,从法理上探讨环境公益诉讼的基本内
容以及与公民权利、社会法治的关系;第二,综观世界各国的环境公益诉讼制度,
探析环境公益诉讼制度的必然性和应然性;第三,从中国国情出发,对建立环境
公益诉讼制度进行思考。全文对环境公益诉讼制度进行了深入剖析,旨在能够对
现代环境公益诉讼制度的困顿和前途有所帮助,为完善环境法治进行有益的探讨。

ABSTRACT

In recent years, the environmental law is ing one of the most controversial
topics; the environmental public interest litigation is a hot focus too. In China, the rule
of environmental public interest litigation hasn’t been set, but attached by other laws.
China's environmental justice can be said in negative situation. The traditional
litigation system of criminal, civil and administrative litigation plays an important part
in solving new environmental disputes and protecting the environment. However, the
environmental public interest litigation is facing new challenges of adaptation to the
social characteristics of environmental law jurisdictions and protection rights of sharing
environment. in this article we gather many views of national and foreign researchers in
order to set up a set of environmental public interest litigation with Chinese style.
In this article, we focus on three issues: the first one is the discussion on the basic
content of the environment public interest litigation, and contact with civil right
