摘要
缓刑制度创立至今,国际上主要有三种:刑罚暂缓宣告、刑罚暂缓执行、缓于起诉。在我国刑法所规定的缓刑属刑罚暂缓执行,即对原判刑罚附条件不执行的一种刑罚制度。学理上分为一般缓刑和战时缓刑。然由于战时缓刑在现实世界和平发展的大前提下适用几乎为零,而一般缓刑经常适用的情况下,笔者认为没有讨论战时缓刑的必要。因此本文只涉及一般缓刑,并且针对缓刑适用、执行与撤销三阶段存在的主要问题,就如何改革和完善我国缓刑制度予以探讨,以提出相关见解和完善对策。

ABSTRACT
Since its establishment, the system of suspension in international world mainly have three forms: punishment postpone declared punishment on the suspension of the execution, slow, to prosecute him. In our criminal law of punishment specified on the suspension of the execution of the probation, namely originally attached to punish a condition does not execute punishment system. Scientific divided into general probation and the wartime probation. But in the real world war because of probation on the premise of peaceful development is almost zero, and generally probation often work, the author thinks that didn't discuss the necessary wartime probation. Therefore this paper involves only general probation, and in order for cancellation, implementing and suspension three stages, the main problems of how to reforming and perfecting the system of suspension to be discussed, and proposes relevant opinions and consummation countermeasure.
