目前,中国对外国际贸易相当的频繁,并且随着经济的发展,国际间的自由贸易将会越来越完善。但是在其蓬勃发展的同时还隐藏着极其具有阻碍力的非关税贸易壁垒,其中知识产权保护被认为是诸多措施中更加难以捉摸的、更巧妙的保护手段。它在知识产权保护的名义下,比传统的非关税壁垒更具隐蔽性、歧视性和报复性,对国际贸易的影响日益加深,因此应引起有关国家的高度关注。像中国这样的发展中国家,应该更深刻地去了解和探索知识产权,以便于在自由贸易中遇见由于产权问题而被终止贸易,甚至告上法庭的时候,能有效的保护好自身的利益。本文首先是通过对知识产权的内涵以及特点进行理解;其次对我国贸易中遭遇知识产权的现状及原因进行分析;再则在政府和企业方面应承担的责任和应该采取的政策做了深入研究。

ABSTRACT
At present, China has frequently international trade; besides, as the development of economic, it will be more and more faultless for the international trade. However, besides its’ development, it also conceals Non-tariff trade barriers which is obstructive, and IPR protection is considered to be much more inscrutable、ingenious among these protection measures. Under the name of IPR’s protection, it is much more invisible、discriminating、revengeful than the traditional Non-tariff trade barriers. Then, it deepened the impact on international trade. So, the relative countries should arise a great concern. In developing countries such as China, Should deeply understand and explore the IPR. So that it can protect own interests effectively when es across the termination of trade, and even gone to court which caused by Property Rights in the international trade. This paper includes Connotation and characteristics of intellectual property rights. Then here it analysts some situations and reasons. So we should take a research either our government pany that what should they do.
