摘要
当前,银行消费者保护法制的发展跟不上行业市场发展的脚步,银行消费者权
益遭受侵犯现象时有发生。针对此种现状,本文从我国银行业现状及美英行业经验
教训等方面进行探索研究,提出若干对策建议,以期对我国银行消费者权益保护体
系健全完善有所裨益。
全文分为四章,约 36160 字。
第一章:银行消费者保护相关要点概述。主要针对银行消费者界定、基本权利
进行阐述,并对保护弱势群体与买者自负、卖者有责原则进行了重点研究,前者能
够保障行业领域处于弱势的个人群体纳入消法保护,后者则凸显市场经济中金融领
域亦须维护消费者权益的真意,有助行业制度理念与内容的进一步完善。
第二章:我国银行消费者权益保护的现状与不足。主要对消费者基本权利受侵
现象、现行法制进行具体阐述,分析得出目前我国行业保护法制除现有制度执行力
度不足外,还存在监管保护意识层次较低、相关投诉维权机制欠妥、行业协会制度
规定难以满足现实需要等方面的缺憾。
第三章:银行消费者权益保护之美英视角。主要探讨两国行业制度建设、机构
设置以及纠纷解决模式等方面的先进经验,同时也正视两国在金融教育、把握审慎
监管与消费者保护现实衡平度、行业消费者保护机构与功能整合等方面的不足所带
来的行业教训,由此对两国经验教训进行综合分析与把握。
第四章:我国银行消费者权益保护之对策选择。主要强调要在切实执行反垄断、
惩罚性赔偿等现行制度前提下,分监管机制、行业协会自律体制、银行机构规制制
度以及消费者维权与教育保障机制四角度进行相关内容的具体优化改进,全面保障
消费者在银行消费中的权益得到充分维护。

Abstract
At present, the development of bank consumer protection law can’t keep up the pace
of bank market development, so bank consumers’ rights are infringed frequently. In order
to improve the system of banking consumer protection, this article will study the current
situation of China’s banking industry, learn from the experience and lessons of the United
States and Britain and make some suggestions.
The article is divided into four chapters. There are about 36,160 words in it.
Chapter Ⅰ: Overview of bank consumer protection. This part elaborates bank
consumer definition and their fundamental rights. It focuses on the principle of
protection of vulnerable groups and the principle of caveat emptor and sellers’
responsible. The former can ensure individual groups protection of Consumer Law,
the latter shows that consumer rights should be protected in financial sector and it
can help perfect relevant system.
Chapter Ⅱ: Current situation and ings of China’s bank consumer
