论文提要
劳动关系是社会关系的重要组成部分在我国随着市场经济改革的不断深入
企事业单位用工制度改革的不断深化劳动者和用人单位双方法律意识的逐步提高
各种类型的劳动争议案件呈上升趋势与此同时劳动争议仲裁作为世界各国通用的
解决劳动争议的法律制度也发挥着越来越重要的作用尤其是 2007 年劳动争议调
解仲裁法的颁布使劳动争议仲裁制度较之以前更加规范的同时也将劳动争议仲
裁推向了一个更加重要的位置劳动争议仲裁的重要性不仅体现在通过仲裁可以解决
劳动争议而且更在于以其自身内在的高效灵活低成本的规定性正好适应了劳动
争议应及时简便高效解决的特殊要求因此更加深入地研究劳动争议仲裁基本
制度不论对劳动争议处理制度的理论完善或是对劳动争议处理实务都具有非常重
要的意义
本文以完善我国劳动争议仲裁制度的基本操作规范为视角首先通过对劳动争
议及其处理制度劳动争议仲裁的介绍引出劳动争议仲裁基本制度的涵义与内容明
确本文的研究对象接着指出完善劳动争议仲裁基本制度的意义然后通过对我国
劳动争议处理现状的描述和基本制度立法状况的概括分析我国劳动争议仲裁的基本
制度研究现行基本制度上存在的问题最后结合上文总结的问题有针对性地提出
完善建议以期在提高劳动争议仲裁的运行效率方面起到指导性的作用本文仅对劳
动争议仲裁的几个基本制度的若干问题进行了分析提出了一些初步的意见和建议
有很多不完善之处对于劳动争议仲裁基本制度整个体系的构建还需要更多的人做更
全面更深入的研究以使我国劳动争议仲裁更健康的发展

Abstract
Labor relations are an important constituent of social relations. In China, with the
deepening of market economy reforms and the reform of employment system of
enterprises and institutions, workers and employers both gradually increase their legal
awareness; therefore, there are more and more various types of labor disputes cases
nowadays. Meanwhile, as a universal solution and the legal system to the world, labor
dispute arbitration has also played an increasingly significant role. As "Labor Dispute
Mediation and Arbitration Law" was enacted in 2007, the labor dispute arbitration system
not only has e more previously standardized, but also was pushing to a more
important position. The importance of the labor dispute arbitration is not only it can solve
lots of labor disputes, but also its characteristics including efficient, flexible and low-cost
are precisely adapted to the special requirements of labor disputes, which is timely, simple,
