摘要
2008 年 1 月 1 日开始实施的《中华人民共和国城乡规划法》对公众参与城市规
划作了明确规定,公众参与城市规划是公民知情权、参与权和监督权的重要体现,
也是公众表达自身意愿和利益需求的重要形式和途径。
邵阳市经过改革开放三十年的发展,经济社会得到很大发展,邵阳市公众的参
与意识开始觉醒和参与积极性不断提高。公众关注邵阳市的城市规划,是由社会主
义民主的性质和我们建设和谐社会主义社会的要求所决定的,也是邵阳市地方政府
还政于民的重要表现。邵阳市城市规划的公众参与是邵阳经济社会发展的必然要
求,是邵阳建设和谐社会和“两型”社会的需要。邵阳城市规划的公众参与有利于
体现邵阳的“精、气、神”,有利于减少邵阳城市规划的失误,有利于防止邵阳城
市规划的腐败行为,从而有利于维护邵阳的社会稳定。
西方发达国家城市规划中的公众参与有较长的历史,也有深厚的理论底蕴。一
方面是其经济社会发展的必然结果和要求,另一方面是西方自由主义传统的反映。
西方发达国家公众参与城市规划有其政治思想基础、社会管理基础以及方法论基
础,其公众参与城市规划以相关理论为指导,并且在实践中丰富和发展这些理论。
西方发达国家城市规划的公众参与理论与实践对邵阳城市规划的公众参与具有一
定的借鉴意义。
改革开放以来,邵阳开始出现公众参与城市规划,但这些城市规划中的公众参
与还处于起步阶段,不成熟、不完善,存在参与内容、参与方式与途径不明确,参
与效果欠佳,相关法律和制度保障不够。
虽然邵阳城市规划的公众参与刚刚起步,但我们可以通过借鉴西方发达国家城
市规划的公众参与经验来推动邵阳市城市规划的公众参与,我们可以通过改革城市
规划教育、向公众普及和传播城市规划知识,转换城市规划职责,公开城市规划决
策,设置城市规划仲裁机构,提高公众参与城市规划的法律地位等措施来推动公众
参与邵阳市城市规划。

Abstract
The enforcing of the "People's Republic of China Town and Country Planning Act,"
on January 1st, 2008, made clear that public participation in urban planning. Public
participation in urban planning is the symbol of right to know, participate in and
supervise an important embodiment of citizen’s, also expressed their own wishes and
interests demand an important form and means.
Shaoyang City after 30 years of reform and opening up the development of the
market economy has e the main form of economic operation, economic and social
development are great, Shaoyang City public participation consciousness awakening of
enthusiasm and participation continues to increase. Shaoyang City public increasingly
concerned about urban planning, this is determined by the nature of socialist democracy
and building a harmonious socialist society we request by the decision, and it is also the
local government of Shaoyang City government to the people of the important
