基于业主方的江苏高速公路项目合同管理体系研究
摘要
随着高速公路的发展,有力促进了中国经济发展和社会的进步,但
高速公路建设仍面临网络尚未形成;特别是中西部经济欠发达地区后续
建设任务大量集中局面,可以说项目更加复杂、工程更加艰巨、造价更
加高昂、筹资更加困难。后续项目的公益性、开发性及节约性要求会更
高,需要政府和社会及利用外资多种投资主体加大直接投入,项目建设
要求在政策扶持、创造良好环境,提升项目管理水平上新台阶。
面对繁重艰巨的建设任务,如何规范高速公路项目管理, 建设合同
规定着项目合同双方责权利关系,合同管理是贯穿于工程实施的全过程
和工程实施的各个方面。它作为项目其它工作的指南,对整个项目的实
施起总控制和总保证作用。可以说,没有合同意识则项目整体目标不明;
没有合同管理,则项目管理难以形成系统,难以有高效率,不能实现项
目的目标。
本文通过对具有特色的江苏省高速公路建设“公司筹资、指挥部建
设”管理模式下的业主方合同管理内容及合同履行的保证体系和实施情
况进行介绍,通过对江苏高速公路建设项目在合同分析、合同监督与协调,
合同变更控制等方面特征研究,为探索高速公路项目合同管理工作新途
径、新办法提供了借鉴。通过案例研究,了解在高速公路项目合同实施
中进行全过程和各个环节、所有工程活动如何实施有效的合同管理,旨
在使国内项目高速公路工程建设参与方不断增强合同管理意识;使作为
建设的“龙头”的项目业主,不断创新合同管理手段,建立起风险预防、
监控和处理的科学、规范合同管理体系,提高高速公路建设项目管理水
平,为高速公路建设的科学发展提供管理理论上的指导。

ABSTRACT
With the development of high way, which promotes the development of
the economy and the progress of the society. But the highway construction
still faces the following : work is not finished, especially the
centralized phase in bulk of next construction task in backward region of
middle and west of china. It can be said that the item is plicated,
the project is more rough , the cost is more higher, financing is more difficult.
It’s more higher for the public character, development character and saving
character of next item which need the government and the society and more
kinds of investment principals from outside increase the direct investment.
And item construction requires the support in policy and creating the good
environment and improving the management level of item to a new level.
Facing the heavy and rough construction task, how to rule the item
management of highway and create the responsibility and the right relation of
contracted two parties in the requirement
