摘要
进入二十一世纪以来,国际贸易迅速发展。我国经济发展出现质的飞跃并加入了世贸组织,此后,我国与世界的经贸往来越来越频繁,但面临的各种贸易摩擦也越来越多,范围越来越广。在知识经济的迅猛发展的今天,知识产权已成为企业乃至国家竞争的焦点,我们走进了一个靠知识产权来参与和知识产权优势,利用知识产权制度和相关国家法律、政策,以“正当”保护知识产权的名义,设置知识产权壁垒,限制发展中国家的企业在国内外市场的竞争,以此达到维护其知识产权优势和市场优势的目的。造成国际贸易领域中知识产权摩擦与冲突不断。在我国加入WTO这样新的形势下,要借鉴发达国家有关知识产权方面的成功经验,根据我国现阶段的经济状况和知识产权现状,制定并实施适合我国国情的知识产权战略。
本文在对国际贸易领域中知识产权分析的基础上,通过对我国知识产权摩擦的实证分析,针对我国知识产权摩擦的现状与表现形式,分析我国遭受知识产权摩擦的原因,进而从我国政府和企业两方面总结出我国应对国际贸易中知识产权的对策。

Friction of intellectual property in the international trade and the measures of our country
Abstract
Entering the 21st century, the international trade develop rapidly. China's economic development came a qualitative leap and joined the world anization. Since then, With more and more frequent trade of our country and world, the trade friction is also ing more and more .With the development of knowledge economy and the deepening of the globalization, intellectual property rights e the focus petition for enterprises, even for countries .we have already walked into an age which rely on intellectual property rights to participate in petition. Developed countries rely on their own advanced technology level and intellectual property advantages and use the intellectual property policies and relevant laws, in the name of “protecting intellectual property rights” to set intellectual property barriers and limit enterprises in developing countries pete in international market, thus they can maintain their intellectual property advantages and market advantage. It cause friction and intellectual property conflicts in the field of international trade. In the new situation that China entry into the WTO, We should use for reference the essful experiences about intellectual property rights in developed countries, and accord to our present economic situation and intelle
