文档介绍:中文摘要摘要:不动产登记公信力以登记这种公示方式为公众提供了可以合理信赖的权利外观,进而通过推定和拟制的法律技术,将登记物权拟制为真实物权,从而保护善意信赖登记的第三人,维护交易的安全。登记公信力作为一个具有浓郁理论品位的论题,一直以来受到理论界的追捧。虽然2007年《物权法》出台,对不动产的登记、善意取得等问题予以规定,但是难免存在一些问题。本文旨在从不动产登记公信力的概念、构成要件与法律效果、对真正权利人的保护四个层面, 运用文献分析法、比较分析法、实证分析法,对不动产登记公信力进行深入的探讨,以期兴利除弊,促进物权的公信原则最终得以完善,从而为社会主义市场经济的发展服务。本论文共3章。除引言外,文章架构及简要介绍如下: (一)不动产登记公信力概述。通过研究国内外立法现状以及前人的学说, 准确厘定公信力的概念;探究不动产登记公信力的理论依据——权利外观说及国家公信力、制度基础——统一登记机关、登记正确率。(二)为不动产登记公信力的法律效果。通过分析不动产登记公信力的适用要件,阐释了其法律效果。探究不动产登记公信力与善意取得的关系。对于两者的关系,是理论界研究的焦点问题。本文拟从介绍、评析各种学说入手,然后就两者的前提、理论基础、法律效果等,总结了两者的实质性联系与区别。(三)为不动产登记公信力的限制与补充及对真正权利人的保护。对于异议登记、更正登记、赔偿等问题,针对现实立法中的不足,提出完善的建设性意见。关键词:不动产登记;公信力;法律效果;善意取得分类号: j丝塞交通太堂亟±堂焦途塞△垦墨!&△£!
