文档介绍：摘要土地是一个国家安身立命之本,是人民生产资料和生活资料的基本来源, 对国家的稳定以及经济发展具有举足轻重的作用。我国自1982年实行家庭联产承包责任制以后,在较短时间内激发了农民种田的积极性,促进了经济的大发展和大繁荣。但随着改革的进一步深化,城镇化和工业化进程的加快,我国农业发展面临着人口增长和耕地减少带来的人均土地资源占有量下降以及农地资源非农化倾向的问题。调整农业结构、规范农村土地流转市场的发展成为我国现阶段面临的主要任务。本文通过对国外主要国家相关土地法律制度的比较研究以及广东南海市、浙江温岭市和重庆麒麟村三地试点的土地股份合作制进行比较分析,探讨我国农村土地承包经营权流转方式的创新及所涉及的法律问题。文章的第二章和第三章主要探讨土地承包经营权的含义、流转形式、流转特征并分析土地承包经营权流转的形成机理;第四章分析我国现阶段土地流转过程中出现的主要问题;第五章研究美国、法国、日本三国土地制度的特点并分析其土地制度给我国完善土地流转制度相应的启示;第六章探讨土地股份合作制的特点,并以广东南海市、浙江温岭市以及重庆市麒麟村为代表,研究三地进行土地流转制度创新的成果,针对存在的潜在问题提出相应对策;第七章从法律层面对我国完善土地承包经营权流转提出建议,具体表现在明确土地所有者、加强对农民权益的保护、规范农村土地监督、完善农村土地信息流转平台等几个方面。关键词:农村土地,承包经营权,承包经营权流转,股份合作制 Abstract Land iSthevery foundation ofthesettlementof anation,the basic source ofthepeople、Sproduction means andsubsistencemeans,which hassignificant influence onthestability andeconomic development of thewhole 1982when China adopted thehousehold contract responsibilitysystem·——_thesystem,which aroused the initiativeofpeasant paratively short timeandprompt the following development andprosperity ofthewhole , along withthedeeper advancement ofthereformandprocess of industrializationandurbanization,theagriculture ofChina hasbeing facing theproblem of declinationofpercapitafarming landandthe inclinationoffarming landfornon-farm theagricultural structuresandstandardizethetransfermarket oftheruralland iS ing themain assignment forthegovernment inthe near future.
