中文摘要在中国,要想解决好人多地少的矛盾,设计高效的土地用益物权制度是关键。土地作为农民最基本的生产资料,对于农业增长,农村发展,农民生存起到了至关重要的作用。随着我国经济的快速发展,农村大量的劳动力流向城市和非农产业,这就为农村土地承包经营权流转市场的发展提供了契机。然而随着流转范围的不断扩大,其中出现了很多法律问题。现行的法律法规虽然对农村土地承包经营权流转作出了相关规定,但规范农村土地承包经营权流转的法律制度仍不健全,对流转中面临的一些具体问题还不能有效规范。因此,如何依法规范农村土地承包经营权流转市场,提高土地用益物权使用效率,保护好流转过程中广大农民的根本利益,是我国社会当前面临的一项重大课题,也是法学界亟需研究的热点。本文以土地承包经营权及承包经营权流转的基本理论和相关立法为基础,首先研究了农村土地承包经营权流转的现状与流转过程中存在的法律问题,详细论述了影响农村土地承包经营权有序流转的诸如承包土地产权界定不清、土地承包经营权登记制度的法律规定不5>完善、农业金融法律制度不健全、非农就业比例偏低等诸多因素,重点分析和研究了该领域立法的实然与应然的差距及其衔接措施,最后探讨了推进我国农村土地承包经营权依法流转的对策建议。关键词:土地承包经营权;流转;农村;法律问题 I
Abstract In order to solve the contradiction of vast population and limited farmland in China, the key is to design an efficient land-use system .As the most basic production material of rural area, land plays a vital role in agricultural growth, rural development and farmers living. With the rapid development of our country's economy, a large rural labor flows to urban and non-agricultural industry, and it provides opportunity for the development of the rural land contract-management right entering market to circulate .However, with the expansion of the circulation, many legal issues also appear in the process. The rural land contract-management right circulation is regulated by the current laws and regulations, but generally speaking, the legal system in the aspect is not perfect and the problems during the circulation still can not be effectively adjusted. Therefore, now, how to use the laws regulating, improving the use efficiency of the land and protecting the fundamental interests of the vast farmers in the circulation process has ing a major issue in our society and also a hotspot of the research on the theory of laws. Based on the basic theory and the related legislation of the rural land contract-management right circulation and selected its current situation and existing problems as a starting point, the article discussed in
