文档介绍：ForceMajeureandNotice不可抗力、通知ForcemajeuremeansaneventbeyondthecontrolofaParty,asaresultofwhichthePartyisunabletoperformitsobligationsunderthisContract、“不可抗力”指一方不能控制的、导致该方不能履行其在本合同项下义务的事件。AneventofForceMajeureincludes,butisnotlimitedto,prohibitionoractsbygovernmentorpublicagency,riot,war,hostility,publicdisturbance,strikes,otherlabordisputesandworkstoppages,failureorinterruptionoftransportationorotherutilities,epidemic,fire,flood,earthquake,storm,tidalwaveorotheractsofnature、不可抗力事件包括但不限于政府或公共机关的禁令或行为、动乱、战争、敌对行动、民众骚乱、罢工、其她劳动纠纷与停工、交通或其她公用事业的停顿或中断、流行病、火灾、水灾、地震、风暴、海潮或其她自然灾害。ForcemajeurepreventingapartyfromperforminganyofitsobligationsunderthisContract,inwholeorinpart,maybeassertedagainsttheotherpartyonlyifthepreventedpartygivesnoticebyregisteredmailoftheinceptionandcessationoftheforcemajeurewithinfifteen(15)uracyofthedatasupplied、一方因遭受不可抗力而不能全部或部分履行其在本合同项下的任何义务,可以通知另一方不可抗力的存在,条件就是遭受方应在不可抗力发生与终止后十五(5)日内,分别用挂号信向另一方发出该不可抗力的起始与终止的通知,并附上有关当局的证明或公开发布的消息,证明事实真相与所提供的材料的准确性。Apartyclaimingforcemajeurehastheburdentoprovethedirectrelationshipbetweentheforcemajeureandthenon-performanceofitsobligationsunderthisContract、声称不可抗力的一方有举证责任,证明不可抗力与未履行本合同规定的该方义务有直接关系。ShouldanyPartybedirectlypreventedfromexecutingthisAgreementorbedelayedinperformingthisAgreementbyanyeventofforcemajeure,suchasearthquake,typhoon,flood,fireandwarandotherunforeseenevents,thehappeningandconsequencesofwhichareunpreventableanduna
