公益性城市房屋拆迁法律制度研究

伴随着我国城市经济建设的飞速发展,城市房屋拆迁也在各地轰轰烈烈的开展起
来,然而,各地城市房屋拆迁过程中产生的问题也是愈来愈多。在现实生活中,政府
与开发商往往以公共利益为名实施拆迁行为,并且给予被拆迁人的补偿也并不合理公
平,在这种情况下,被拆迁人失去了作为安身立命之本的房屋,又无法去购置新的住
所,矛盾的产生自然在所难免。那么,在城市房屋拆迁中的公共利益应当如何界定?
如何保证公益性城市房屋拆迁法律制度的公平公正合理?本文将通过比较分析和实证
研究的方法,对各国的城市房屋拆迁法律制度下与公共利益的规定加以介绍并进行比
较,同时对中国目前城市房屋拆迁法律制度中对公共利益的立法加以总结,进而对公
共利益与城市房屋拆迁的关系进行研究,提出对公共利益进行界定的原则与标准,并
结合世界各国拆迁制度,对完善公益性城市房屋拆迁法律制度进行相关研究,以期对
完善我国公益性城市房屋拆迁立法有所裨益。

Abstract
Along with our country economy of the high speed develop,city house demolishing
and relocation develop in each city to launch magnificent and victoriously,while the
dissension about city house demolishing and relocation e more many
city,taking public interests and urban construction investment and development as an
excuse,with forcible administration action,local government carries out the old house
removal and resident relocation on a large scale,pensation for the resident neither
legitimacy nor reasonable,under this situation,houses owner obtained pensation
which cannot afford their relocation, so the contradiction bring to be to
define the public interests in monweal house demolishing and relocation?How to
guarantee the equity,impartiality and rationality of the city house demolishing and
relocation? This paper parative analysis and analysis of demonstration, briefly
introduced pared the system about city house demolishing and relocation and
definition about public interests in foreign country and our make the
principle and standard in order to define public bine with the other country's
system about city house demolishing and relocation,I will provide some feasible
suggestions to improve monweal house demolishing and relocation system.
