农村医疗保障法律制度研究

摘要
党的十六大提出了全面建设小康社会的奋斗目标,同时也提出了在“有条
件的地方,探索建立农村养老、医疗和最低生活保障制度”的任务。党的十六
届五中全会进一步明确提出:加快完善社会保障体系,建立健全与经济发展水
平相适应的社会保障体系⋯⋯农村社会保障体系是我国社会保障体系的重要组
成部分,也是薄弱环节,建立和完善农村社会保障体系是全面建设小康社会和
建设和谐社会的重要内容,是迫切需要破解的难题。
本文第一部分介绍了我国农村医疗保障制度的历史演变。我国的医疗保障
制度创建于新中国成立后,并取得了积极的效果; 改革开放后农村实行了
家庭联产承包责任制,农村医疗保障制度开始衰落; 年党和政府开始重新
重视农村医疗保障制度,开始了新的医疗合作试点,努力完善农村医疗保障制
度。第二部分对我国农村医疗保障制度现状进行了分析,我国医疗保障制度重
建后也取得了一定的成果,而且具有新的特点,同时也存在着不足,着重介绍
了目前农村医疗保障制度中存在的问题。第三部分列举了发达国家德国和日本
医疗保障制度,也列举了发展中国家巴西和印度的医疗保障制度,不同的国家
实行不同的农村医疗保障制度,这些国家医疗保障制度的成功经验,对中国农
村医疗保障制度的建设有可借鉴之处。第四部分对完善我国农村医疗保障制度
提出建设性的建议,加强政府在农村医疗保障中的责任,改革城乡二元结构的
户籍制度,建立科学合理的医疗保障资金筹措机制,实现医疗保障制度的法制
化,并加强农村医疗保障各项措施的监督管理。

Abstract
The 16th National Congress munist Party of China has proposed the objective of the
struggle of the well-off society prehensive construction, propose task in " conditional place,
explore, set up rural living out one's life in retirement, medical treatment, minimum living security
system " at the same time. 16 sessions of the fifth plenary session of the party are further proposed
clearly: Accelerate improving the social security system, set up and amplify the social security
system in conformity with economic development level ……The rural social security system is the
ponent of the social security system of our country, it is a weak link too, it is well-off
societies of prehensive construction to set up and improve the rural social security system
and build the important content of the harmonious society, it is the difficult problem needing to
analyze and explain urgently.
This text first part mended the countryside of my country to ensure the historical
development of the system medically. The medical treatment of our country ensures the system to
establish and make the positive result after new China is established; Having implemented the
family-contract
