我国电信行业反垄断的法律规制研究

摘要
年工业和信息化部、国家发改委以及财政部联合下发电信行业重组公
告,形成中国电信、中国移动、中国联通三家拥有全业务的基础电信企业,我
国电信市场竞争格局发生重大改变。文章针对我国电信重组后的市场垄断现状,
通过分析比较各国电信行业反垄断法律规制的立法和实践,对电信行业如何适
用《反垄断法》,以及反垄断法与传统的行业管制如何协调提出了具体对策,
并提出加快出台行业专门法《电信法》,以构建我国完善的电信行业反垄断的
法律规制制度。文章内容框架安排如下:
第一章绪论,介绍论文选题的背景和意义,以及对一些重要论点进行文献
综述等。
第二章对电信行业的概念进行界定,概述了电信行业自然垄断性质的动态
发展,以及在阐释竞争与垄断的博弈性基础上论述了电信行业竞争引入的问题。
第三章分析了我国目前电信行业在基础电信服务和增值服务领域的垄断状
况,包括互联互通、交叉补贴、必要设施垄断等六个方面。
第四章较为详细地描述了我国电信行业反垄断规制的改革历程,以及从监
管部门、监管内容方面论述了我国当前电信行业反垄断规制的状况。
第五章分析了包括美国、英国、德国等发达国家电信行业反垄断规制的立
法和实践,在此基础上与我国电信行业发展轨迹、规制政策、规制方法等方面
进行比较,并得出启示。
最后,文章对我国电信行业垄断法律规制制度进行了构想:①电信行业反
垄断规制必须依据有效竞争、有效规制、保护消费者和经营者的原则;②制定
行业专门法《电信法》,从规制效力和规制范围上保障电信业市场的公平竞争
以及健康有序地发展,并坚持电信行业按照“一般适用,例外豁免”的原则适
用《反垄断法》;③在协调行业管制和反垄断法规制的关系上,采取分权合作

模式,确立“共同管辖”和“有合作的专门管辖”的分工、协调机制,以解决
电信领域的竞争问题。

Abstract
2008, six ministries jointly issued a munications industry restructuring announcement
that formatting three full-service based pany-China , China
Mobile, China .Aiming at Chinese munications monopoly market after
restructuring situation, the munications industry through the analysis parison of
countries monopolize the practice of legal regulation of the munications industry how to
apply the “anti-monopoly law” and anti-trust regulation and the traditional industry and put forward
specific measures to reconcile. And speed up to introduce the “munications Act”, to build
the perfection of the legal monopoly of the munications industry regulatory system in
China .The framework content of the article as follows:
The first chapter-introduction, introduces the background and significance of topic selection,
as well as some important points of the literature review and so on.
