外资银行市场准入法律制度研究

摘要
随着金融自由化与全球化的发展,外资银行市场准入已经成为各国金融开
放共同关注的焦点。东道国金融监管当局通过实施市场准入监管,能够有效预
防外国资本对本国银行业的负面影响,对维护本国银行业的利益以及维护本国
金融体系的安全与稳定具有十分重要的作用。
本文以传统的金融监管理论和现代跨国银行监管为基础,通过对外资银行
市场准入监管实践的考察,探讨了在金融全球化发展趋势下对外资银行市场准
入进行适度而有效的监管,并在此基础上提出了完善我国外资银行市场准入监
管及其法律制度的对策。
全文除了导论和结论外,共有五个部分。
第一部分:外资银行市场准入概述。本部分是全文的起点。首先,阐述了
金融全球化对我国外资银行市场准入的影响。其次,分析了设立外资银行市场
准入制度的必要性。
第二部分:外资银行市场准入的理论基础。通过探讨相关的经济学理论和
法理学理论,提出了外资银行市场准入监管的理论依据,为本文的研究提供了
理论上的支持。
第三部分:外资银行市场准入制度的国际法分析。本部分通过探讨成
员国、巴塞尔委员会关于外资银行市场准入监管国际协调的有关规定及其实践。
第四部分:外资银行市场准入的待遇标准评析。本部分从保护主义、对等
互惠原则、最惠国待遇原则、国民待遇原则出发,论述了当今世界各国对外资
银行市场准入监管的主要政策取向。本文提出了我国应以互惠待遇标准为主,
构建我国外资银行市场准入法制体系。

第五部分:我国外资银行市场准入的具体制度安排。本部分主要论述了我
国外资银行市场准入监管及其法律制度的设计与完善,指出了我国在外资银行
市场准入监管及其法律制度方面存在的问题与不足,进而提出了在立法和实践
两个方面完善我国外资银行市场准入监管及其法律制度的对策和建议。

Abstract
With the development of liberalization and globalization of finance, the
problem of market access for foreign banks has e the focus for the
countries to open their financial markets. In order to prevent foreign
capital from impacting and rating excessively on the native banking
and to maintain the safety and stabilization of native banking and the
trade of financial globalization, the vast majoring of countries have
strengthened the supervision on market access of foreign bank in the
world. Based on the WTO’s relevant request and China’s agreement about
the opening of banking, our country must perfect our country’s
supervision and its legal system on market access of foreign banking. For
this reason, the author advances some useful suggestions to perfect our
country’s supervision and its legal system on market access of foreign
bank by studying some problems on it in the thesis.
