内容摘要
金融是现代市场经济核心,金融的稳定直接关系到国民经济稳定健康地发展,
而银行的稳定又是金融稳定的核心关键。银行业的市场准入问题,作为银行“生命
周期”的“初生期”和金融监管的“源”,更是在各国银行业监管法制中得到了普遍
关注。在世界贸易法律体系中,市场准入是最受重视的问题之一。金融服务贸易领
域中的市场准入壁垒的减少和消除,也是世界贸易组织成员谈判的重要课题。本文
在探讨银行业市场准入监管法律基本理论的基础上,结合巴塞尔委员会有关跨国银
行准入的有关文件,在比较鉴别中论述了我国的银行业市场准入法制,并对其存在
的问题和对策作了系统的探讨。
全文除导言和结语外,共分三部分,约万字。
第一部分研究银行业市场准入监管的基本法学理论。该部分在分析介绍银行市
场准入概念的基础上,探讨了银行业的特殊性与银行市场准入监管的必要性,最后
导出了银行业市场准入监管的目标和立法原则。
第二部分研究巴塞尔委员会与跨国银行市场准入监管。本部分在介绍巴塞尔委
员会有关跨国银行监管的发展概况的基础上,对其自 1979 年成立以来有关跨国银行
准入监管方面的 5 个文件作了简述,并着重研究了《有效银行监管的核心原则》及
《评价方法》。
第三部分研究我国银行业市场准入监管法律制度。该部分在论述我国银行业市
场准入监管法律的基础上,联系我国入世的承诺,并借鉴巴塞尔委员会有关跨国银
行准入监管方面的实践,指出我国银行业市场准入监管法律制度存在的不足并提出
了完善建议。

Abstracts

Finance is the core of modern market economy and financial stability
directly influences the even development for national economy,while stability
of bank is also the central point of financial stability. As the starting period of
life period in bank and resource of financial supervision,the question of
market access to banking is mon attention in supervision legal
system of banking in various access is one of the questions
mostly recognized in legal system of world and elimination
of barrier for market access in financial service trade field is also the
important subject of negotiation for members of on discussing
the legal basic theory of market access supervision in banking
bined with the access supervision law in developed countries and
related transnational bank in mittee,the article desires the access
legal system of banking market in China with parision method,it also
makes a systematical discussion to its existent problem and countermeasure.
