政府在住宅小区物业管理中的角色与行为研究
摘要
自 1981 年深圳市成立第一家住宅小区物业服务企业以来,住宅小区物业
管理发展迅猛,现在已经成为社区建设、城市管理不可缺少的组成部分。但
是相对于新加坡等国家的住宅小区物业管理而言,目前我国住宅小区物业管
理仍处于开拓期,在其发展中存在许多问题,总体来讲有物业纠纷多和物业
缴费率较低,物业服务企业运行不规范,业主维权行为不成熟,公共事业单
位不承担相应责任几方面问题。从政府角度来讲,这些问题与政府制定的住
宅小区物业管理法律规范体系不完善、物业管理行政机构系统化程度不高、
政府对公众的物业管理观念缺乏引导,政府对物业管理行业协会的扶持不够
等方面相关。因此从公共管理角度讲,政府应该在住宅小区物业管理中担当
住宅小区物业管理多元治理体系的引导者、住宅小区物业管理法律规范体系
的制定者和其他住宅小区物业管理主体(物业服务企业、业主委员会等)发
展的扶持者。相对于政府扮演的角色而言,政府在住宅小区物业管理中应该
完善住宅小区物业管理法律规范体系以规范物业服务企业和业主(或业主委
员会)的行为,扶持物业服务企业发展,扶持住宅小区业主委员会、居民委
员会等自治组织的发展,并最终与物业服务企业、业主共建和谐社区。

GOVERNMENT FOR THE PROPERTY
MANAGEMENT OF RESIDENTIAL ZONE
ABSTRACT
Since reform and opening-up, the Housing Construction has made great
achievements in China, and people's housing conditions were significantly
improved. Since the first property pany was founded in the city of
Shenzhen in 1981, the property management of residential zone has made a great
change. The property management of residential zone has e an important
part in urban management munity building. pared with the
property management of residential zone in Singapore, the property management
of residential zone in China is plete, and there are many problems to be
solved, such as, the legal system about the property management of residential
zone in China is plete, the property panies work not very well,
the owners are not the rival of the property panies, the institutions who
supply water and gas to the public don’t accept the responsibility which should be
accepted, and so on. From the view mon management, the government
doesn’t play well his role in the property management of residential zone. In my
opinion, Chinese government doesn’t formulate and implement the legal system
about the property management of residential zone well, and the systemati
