论国有土地使用权人的公共义务与征收补偿

摘要
国有土地使用权人的公共义务与征收补偿问题,集中表现为当政府为了公共
利益,对国有土地使用权进行规制,给国有土地使用权人的利益带来损害时,是
属于国有土地使用权人应尽的公共义务,不需对其进行补偿,还是构成了事实上
的征收而必须给予其补偿。对此,我国目前尚未有明确的法律规定。关于解决这
一问题的学说,主要有警察限制与公用限制区分说、形式基准与实质基准结合说、
实质基准说和综合判断说,但都有其缺陷。为实现个案公正,宜运用多因素衡量
法,在个案中进行事实调查,综合考虑国有土地使用权规制对使用权人的经济影
响、规制的性质、手段与目的之间的联系、社会的一般观念等因素,尤其应重点
考虑规制的性质及其经济影响大小。

Abstract
Publicl obligation pensation of national land users issues focus on the
situation that government governs state-owned land use rights forthesakeof public
interest damages the interest of national land users,which belongs obligating of the
national land users or the situation pensation must be given in case of the fact
that they has levied. In this regard, China is not yet clear legal provisions. Theory on
the solution to this problem,mostly like limitations and restrictions on mon
distinction between the police said, real base said and the said prehensive
judgments,which all has its achieve the justice in single case, judges should
make use of multi-factor equal law, considering property regulation to the property's
economic impact, property,the links between means and purpose and society's general
idea , particularly the nature of the property and the size of the economic impact in the
case.
