摘要
作为我国两审终审制例外的死刑复核程序,是一种仅适用于死刑案件的特殊审
判程序。是为了贯彻我国“少杀、慎杀,防止错杀”的刑事政策,实现“尊重和保
障人权”的宪法规定而设置的一项特有制度。
由于我国在刑事审判程序价值观念上的滞后,过于追求审判效率,长期以来死
刑复核程序并没有真正实现其价值目标。2007 年 1 月 1 日起,我国最高人民法院彻
底收回了对死刑案件的核准权,这是推进我国司法进程的一个重大举措,维护了立
法、执法的统一,解决了长期存在的复核程序与二审程序合二为一等问题。然而,
收回死刑核准权后,我国的死刑复核程序仍然存在诸多问题,其中突出的问题就是
现行死刑复核模式的“行政化”问题仍然没有得到根本改善。因此,如何改现行的
行政复核模式为规范的诉讼化复核模式,是理论和实践上都急需研究和解决的问题。
本文中笔者就以诉讼化为研究视角,首先,对我国死刑复核程序的内涵与功能
进行分析;其次,阐述我国死刑复核程序的历史沿革并作评析;最后,通过对死刑
复核程序参与主体、程序事项等方面所存在的缺陷的分析,提出了完善我国死刑复
核程序的具体构想。本文对我国收回死刑核准权之后的死刑复核程序继续改革作了
一些有益的探讨,虽有可能仍嫌肤浅和不够成熟,但希望以此来对我国死刑复核程
序的完善和发展尽微薄之力。

Abstract
As the exception to the two-tier trial system, the procedure for review of death
sentence is the only special court proceeding for death penalty case. It is a particular
policy to establish to implement the criminal policy of “little kills, cautious kills,
preventing killing wrongfully” and the constitution of “respect and ensure human rights”.
For the hysteresis value conception of criminal trial procedure and pursuing
excessively for trial efficiency, the procedure for review of death sentence hasn’t truly
achieved the value goal in a long time. Since January 1, 2007, the Supreme People's Court
has taken back the authority over review and approval of the death pletely. It
is a significant action to promote the judicial process and unifies the legislation and law
enforcement and solves the problem of mixing the proceeding for revision with the second
instance's procedure to oneness. However, there are many problems exist in the procedure
for review of death sentence after taking back the authority over review and approval of
the death sentence, among them, the “administrative” problem on current death penalty
reexamine mode is the evident one which hasn’t improved substantially. Therefore, how
