我国法官职业化和专业化之路径探析
中文摘要
法官制度是国家政治制度的一个重要组成部分。随着中国政治体制改革的深入,
法官制度的改革日显其重要性,1999 年《宪法修正案》确立“中华人民共和国实行依
法治国,建设社会主义法治国家”以来,法官制度的改革得到了空前的重视。2001 年
修订了《法官法》,2002 年举办了第一次国家司法资格考试,此后只有通过国家司法
考试的人才能进入法官队伍,中国法官制度改革已进入了关键时期。
本文从中国法官队伍的现状及我省首推的法官考评体系,从中国法官职业化、专
业化的进程中,探析中国法官的职业化与专业化之路,以推进中国依法治国方略的进
程,提高中国法院、法官的社会公信力,真正实现中国审判工作“公正与效率”的最高
价值目标。全文共分为四大部分,第一部分着重讨论中国法官队伍的现状,即非职业
化与非专业化特征与对职业化、专业化的迫切需求;第二、三部分讨论专业化与职业
化的理论、标准与司法实践;第四部分则讨论中国法官实现专业化与职业化建设之路
径或办法。通过全文的分析,文章试图指出,当前中国司法队伍建设中,专业化与职
业化是必不可缺的趋势。

Study on the professionalization and specialization of
judges in China
Abstract
Justice system is an important part of the country's political systems. As China's
political system is deeply reformed, it’s more and more important to reform the Justice
system. In 1999, <Amendment to the constitution of the PRC> made it clear that “the PRC
should rule the country by law, build a socialist state under the rule of law.”, from then on,
We have paid the most attention to the Justice system reforms. In 2001, the <Law on
Judges> was revised, the first National Judicial Examination was held in 2002. After that,
only those who passed the national judicial examination could e judges, Justice
System reform in China has entered a crucial period.
From the status of judges in China, from the course of the specialization and
professionalism of judges in China, the article thinks of searching the path of
specialization and professionalism of judges in China in order to promote the process of
China's “rule the country by law” and improve the social credibility of China's courts and
judges and realize the maximum value goal of the trial in C
