摘要
二十一世纪信息传播迅猛发展,互联网广泛普及,个人信息被誉为 21 世纪
最有价值的资源。个人信息不但可以为政府决策提供依据,而且经过商业利用之
后可以产生利润。个人信息的商业价值一旦被发现,也就意味着它将面临各种侵
害。消费者在消费过程中提供自己的个人信息后,经营者可能把消费者的个人信
息变成“商品”,多次进行“倒买倒卖”,从中牟利。目前,社会上已经出现大量
兜售房主信息、股民信息、商务人士信息、车主信息、电信用户信息、患者信息
的现象,并形成了一个新兴的产业。大量滥用消费者个人信息的行为不仅侵犯了
消费者的合法权益,而且也扰乱了消费者的生活安宁。但是,我国还没有保护消
费者个人信息的立法,导致消费者个人信息被滥用之后,消费者难以获得救济。
鉴于此,本文以消费者个人信息的保护为研究对象,试图在考察部分国家和地区
相关立法的基础上,提出建立我国消费者个人信息保护法律制度的构想。
本文首先阐述了保护消费者个人信息的重要意义,反思了我国消费者个人信
息保护的现状及问题,分析了保护消费者个人信息面临的障碍,然后较系统地介
绍了欧盟、美国、日本以及我国香港、台湾地区保护消费者个人信息的立法模式、
主要制度及其对我国的借鉴意义,并在此基础上提出了我国消费者个人信息保护
立法的初步构想,包括立法模式和主要内容。

Abstract
The twenty-first century, the rapid development of information dissemination, the
widely available, personal information known as the 21st century's most
valuable resource. Personal information will not only provide a basis for government
decision-making and after mercial use can generate profits. Once the personal
information mercial value are found, which means that it will face against.
Consumers in the consumption process to provide your personal information, businesses
may be the consumer's personal information into a "commodity", repeated
"profiteering" from. Currently, munity has a large number of homeowners
selling information, investors’ information, business people information, the owner of
the information, munications, user information, patient information, and have
formed a new industry. A lot of misuse of personal information of consumers have not
only violated the legitimate rights and interests of consumers, but also disrupted the
tranquility of life of consumers. However, China has also failed to protect consumer
personal information, legislation, lead to misuse of personal information of consumers,
