中文摘要
惩罚性赔偿制度起源于英美法系国家。我国属于大陆法系国家,在民事赔偿
领域传统上认为损害赔偿的目的仅在于补偿受害人的损害。但是随着时代的发展,
补偿性损害赔偿制度的局限性日益突显。近年来我国产品责任案件的数量快速增
长,补偿性赔偿无法惩罚不法行为人,也无法对不法行为人和潜在的不法行为人
构成威慑,因此,借鉴国外经验,在我国产品责任领域建立惩罚性赔偿制度成为
当务之急。
本文分三个部分对惩罚性赔偿制度进行了初步探讨。
第一部分主要介绍了惩罚性赔偿制度的一些基本问题,包括惩罚性赔偿制度
的概念、历史沿革,惩罚性赔偿制度的功能:惩罚功能、威慑功能、补偿损害功
能、鼓励市场交易功能。
第二部分介绍了美国产品责任领域惩罚性赔偿制度的适用情况,包括该领域
中惩罚性赔偿的产生、惩罚性赔偿引发的争议、惩罚性赔偿适用的主要行为类型、
成立要件、出现的赔偿数额过高和重复惩罚问题及其改革措施。
第三部分介绍了惩罚性赔偿制度在我国的现状,并提出在我国产品责任领域
建立惩罚性赔偿制度的建议,需要考虑的因素包括:与精神损害赔偿、补偿性赔
偿的协调,适用规则设计,惩罚性损害赔偿金的计算。

A Study on Punitive Damages of Product Liability
Abstract
Punitive damages system can originate from Anglo-American law system. China
belongs to the continental law system; we traditionally believe that the purpose of
compensation for damages lies in the victim's pensation in the field of civil
compensation. However, with the development of Times, the limitation pensatory
damages system has been increasingly occurs. In recent years, the amount of product
liability cases grows rapidly in our country. Compensatory damages cannot punish
illegal person, nor form the deterrence to the potentially illegal person. Therefore,
establish punitive damages system in the field of product liability e an urgent task
by learning the experience of foreign countries.
In this article, punitive damages system will be discussed mainly from three parts.
The first part mainly introduces some problems of punitive damages system,
including the concepts、historical evolutions and functions of punitive damages system.
The functions of it cover punishment function, deterrence function, compensation
damage function and encourage marke
