司法制度改革是我国政治体制改革的重要内容之一,是包括司法理念、工作方法、
管理体制和运行机制等内容在内的全面改革,是一项关系审判工作全局的重要工作。
每一项司法制度的设计和司法程序的运作都在一定程度上体现相关的司法理念及其
价值观,改革拓宽司法民主制度的领域,通过让更多的公众民主参与、民主监督司法
机关活动,支持司法机关的公正司法,进而保障平等地维护公民合法权益,从而以司
法制度建设促进人民民主,使司法制度的法制效果与社会效果统一于“司法为民”。
人民陪审员制度作为社会公众监督法官正确行使司法权,遏制司法腐败、促进司法公
正、加强司法独立的一项基本的审判制度,已为世界上许多国家所采用,被人们视为
宪法民主的象征。笔者作为一名审判实务工作者,也深刻体会到人民陪审员在纠纷解
决的各个环节参与,既丰富了人民群众参与社会管理和公共服务的途径,又利于其作
为社会力量参与纠纷的解决。在本文中笔者将结合审判实务的体会,试图以人民陪审
员制度为视角,分析其地位和作用,探究其运作机制和规律及其不足与待完善处,来
讨论其对司法改革的民主进程具有的重要理论和实践意义。

Abstract
Judicial reform is an important part of political system in China. It is prehensive
reform including judicial philosophy , working methods , management system and
operational mechanism. It is an important work of the overall situation of the trial.
Construction of the judicial system and the operation of the judicial process reflect the
philosophy and values of justice. Reforming the judiciary and broadening the areas of
democracy,We can safeguard the legitimate rights and interests of citizens by allowing
more people to participate in the democratic supervision process. The jury system has been
adopted by many countries in the world as a fundamental trial system. It can supervise the
judgers to exercise judicial power ,curb the judicial corruption and strengthen the
independence of the judiciary. It is also seen as a symbol of constitutional democracy. It is
no doubt that the implementation of the jury system can not only enrich the people to
participate in social management and public ser
