摘要
作为资金密集型行业的航运业,其投资主要体现在对船舶的投资。目前,世界上没有一家航运企业完全利用自有资金造船或者购买船舶,都是通过船舶融资来达到船舶投资的目的。在船舶融资的众多手段中,比较常用到的是采用船舶融资租赁方式。融资租赁是一种比较富杂的资金融通方式,涉及到多个当事人和众多的法律关系。因为我国的立法还没有明确的对船舶融资租赁进行规定,在实践中还有许多争议点和值得注意的方面。本文即对这些问题进行分析,并提出自己的观点和建议,希望能为融资租赁实务提供参考。
本文除引言共分为三章。
第一章主要介绍船舶融资的主要类型和实现途径。明确船舶融资的定义和主要融资渠道。并对融资中采取的担保方式进行介绍和分析。为读者更好的理解船舶融资租赁做好铺垫。
第二章主要论述船舶融资的典型方式——融资租赁。对融资租赁的概念予以明晰,并将其和实践中较容易混淆的光船租赁进行比较,使读者能更好的分辨融资租赁这一法律关系。重点论述了船舶的物权在融资租赁中的确定,辨析了新造船在融资中设定担保的问题和融资租赁的出租人对于船舶物权的控制。最后,对于融资租赁合同进行了解析,并对融资租赁合同的相对性问题提出了自己的看法。
第三章总结了船舶融资租赁市场仍然面临了哪些问题,并对这些问题提出了自己的呼吁。

The Analysis of Legal Issues of Shipping Financial Leasing
Abstract
Shipping business is a capital-intensive industry, the investment focus on the ships. Nowadays, none of the panies purchase all the ships with their own money. Shipping finance is an indispensable financial instrument to be used in the shipping investment. In practice, the shipping finance has sorts of means, Shipping financial leasing mon in use, which is a plicated form of shipping finance and involves many parties and legal relationships. There are no definite stipulations with regard to shipping financial leasing and many disputes and problems arising accordingly. The author will try to analysis these problems and put forward some advice to the practice of ship financial leasing on basis of the above legal issues.
This whole dissertation can be divided into three chapters except for the preface and conclusion.
In Chapter one, the author clearly defines shipping finance and introduces the main forms of shipping finance, measures of guarantee in the progres
