文档介绍：I 摘要土地征收补偿制度早在罗马时期就出现了,随着人类社会的发展,人地关系逐渐紧张,国家为了公共利益需要而不得不对部分集体用地进行征收的现象增多,土地利用中的个人利益与社会公共利益的冲突日益明显。而由于我国的土地征收法律制度不够完善、征收程序欠规范、农民的权利意识增强但法制意识淡薄等因素导致土地征收过程中产生大量纠纷,群体性事件时有发生,严重影响社会稳定。针对这些原因和问题本文提出了预防和解决土地征收补偿纠纷的一些对策,如完善征地拆迁的补偿政策、颁布专门的土地征收补偿条例、加强宣传教育提高农民素质、构建征地拆迁纠纷的解决机制等。希望这些对策能够帮助我国尽快减少土地征收纠纷直至最终解决土地征收纠纷,促进社会经济的和谐发展。关键词: 土地;征收;补偿;纠纷;对策 II ABSTRACT Land pensation system has appeared in the Roman period. As the development of the human society , the relation between human and land e more and more tense. In order to satisfy the public interests , the country has to levy the collective la nd. The conflict between the pe rsonal interests and social interests is increasingly clear. As the land expropriation legal sy stem is not perfect , the expropriation proced ures are not standard , and the farmers’ awareness of rights is enhanced but their sense of the rule of law is weak , a large number of disputes appear in the land expropri ation process and mass incidents occur from time to time. These seriously affect the social stability. In view of these causes and issues , this thesis raised some countermeasures for the prevention and settlement of land pensation disputes. For example , complete the land expropriation compensation policy , promulgate special regulati ons of the land expropriation compensation , strengthen the publicity and education to improve the quality of farmers , construct the settlement mechanis m of land pensation disputes , etc. I hope these countermeasures can help our country to reduce the land disputes as soon as possib le until the final settlement of the land expropriation disputes , and promote the development of socio-economic.
