完善我国环境保护公众参与制度的思考

摘要
环境保护公众参与是指公民和社会团体按照按照法定的程序和途径,平等的参
与环境保护活动。目前公众参与已成为许多国家环境法中的一项基本原则,我国环
境法也是如此。环境保护公众参与在环境保护理论与实践中具有举足轻重的地位,
要使环境保护得到有效的实施必须要坚持公众参与原则。
我国目前已经对环境保护公众参与有了明确的规定,这是一个突破性的进展,
但令人遗憾的是,实践中,受制于多种原因,环境保护公众参与原则并未完全落到
实处,与国外相比,仍存在很多问题。本文对如何完善我国环境保护公众参与这个
问题进行了一番研究,期望能对现行环境保护公众参与制度提供一些有意义的参考。
本文共有四个部分。
第一章是“环境保护公众参与制度概述”。主要介绍了环境保护公众参与的一般
原理,包括三部分,第一部分介绍了环境保护公众参与制度的基本情况,以及历史
渊源。第二部分介绍了环境保护公众参与制度的理论基础,从理论上论证了环境保
护公众参与的必要性。第三部分介绍了环境保护公众参与制度的社会基础。
第二章是“国内环境保护参与现状及问题”。包括两部分,一部分介绍国内的环
境保护参与现状,主要是将国内有关于环境保护参与的现行法律法规进行整理。另
一部分则指出我国环境保护公众参与目前所存在的问题。
第三章是“国外环境保护公众参与现状”。分为两部分,第一部分讲国外公众参
与的现状,对国外的公众参与情况进行了论述。第二部分则说明了国外环境保护公
众参与的特点。
第四章是“完善我国的环境保护公众参与制度”。本章分别从环境保护公众参与
权、环境信息公开制度、环境公益诉讼、社团参与环境保护四个方面,对我国环境
保护公众参与如何完善进行了设想。

Abstract
The environmental protection public participation is refers to the citizen and the
social group according to defers to the legal procedure and the way, equal participation
environmental present the public participation has e in many national
environment law a basic principle, our country environment law also is
environmental protection public participation in the environmental protection theory and
the practice has the pivotal status, must enable the environmental protection to obtain the
effective implementation to have to have to persist the public participates in the principle.
China currently has on public participation in environmental protection had clear
rules, this is a ground-breaking progress, but that, unfortunately, as a practical matter,
subject to a variety of reasons, public participation in environmental protection is not fully
the principles into practice, compared with foreign countries, many problems still exist.
